Introduction


These Terms and Conditions govern the contractual relationship between Gussex and the users of the GUSSEX application, which is owned and operated by Gussex (hereinafter, “users”), and define the conditions governing the use of the GUSSEX services.
By registering on GUSSEX, via the mobile applications for iOS and Android (hereinafter, the “mobile apps”), the user declares that they accept these Terms and Conditions. If the user does not agree with these Terms and Conditions, they must not register.

  1. Scope of Use
    These Terms and Conditions apply to the use of the GUSSEX website and mobile apps, as well as to all websites operated by Gussex that refer to these Terms.
    Any deviation from these Terms must be expressly authorized in writing by Gussex. These Terms constitute the conditions of use together with any additional agreements entered into between the user and Gussex.
  2. Contract Formation, Commencement, Fees
    a. A contract between GUSSEX and the user is formed when the user creates a user account by registering free of charge on the website or mobile app.
b. Registration is completed by filling out the registration form. Users may register using third-party login services (e.g. Facebook Connect). In doing so, certain profile data may be transferred to the GUSSEX database.
c. GUSSEX reserves the right to refuse registration for objective reasons, including violations of these Terms, fraud prevention concerns, identity doubts, suspected spam, age doubts, bad faith, or registration from unsupported markets.
d. The service is free and financed by advertising. Paid features may be accessed via individual purchases or subscriptions.
e. Each user may create only one account. Blocked users may not re-register.
f. Use is permitted only to natural persons who are of legal age.
g. Use by sex offenders is prohibited, including individuals registered as sex offenders in the U.S. or convicted of offenses related to child protection or equivalent crimes.
h. WE DO NOT VERIFY CRIMINAL RECORDS, but publicly available information may be reviewed in cases of justified suspicion.
  3. GUSSEX Services
    a. GUSSEX Community
    GUSSEX operates a social platform allowing users to meet for friendship or relationships. Users can view profiles containing photos and information and communicate with other users.
    Users are authorized to upload, store, publish, distribute, transmit, and share content in compliance with applicable law and these Terms.

  4. In certain countries, GUSSEX offers a Live Video feature allowing users (“streamers”) to broadcast live video to viewers.
  5. Viewers may comment publicly, join as guest streamers, and send virtual gifts using in-app credits.
  6. Broadcasts may be shared simultaneously across other apps operated by Gussex, with prior notice.
    c. Security, Scope, and Availability
  7. GUSSEX provides a free spam filter for private messages without guaranteed success.
  8. GUSSEX may modify or discontinue features at any time.
  9. Average annual availability is 96%, excluding maintenance, updates, force majeure, or third-party failures.
  10. Paid Features
    Users may purchase paid features such as subscriptions or virtual goods. Prices are shown prior to purchase. Paid features may be time-limited and account-bound.
  11. Subscriptions
    Subscriptions renew automatically unless canceled before expiry. Cancellation must occur at least 24 hours before renewal. Subscriptions purchased through Apple App Store or iTunes must be canceled through those platforms.
  12. Virtual Goods
    Virtual goods are non-transferable, account-linked, and non-refundable. Deleting an account results in irreversible loss of virtual goods.
  13. User Account Termination by the User
    Users may terminate their account at any time via account settings or written request. Upon termination, all account functions expire except independent subscriptions.
  14. Account Termination by GUSSEX
    GUSSEX may terminate accounts with notice or immediately in cases of serious violations, fraud, or illegal activities. Refunds apply only to unused paid features.
  15. User Obligations
    Users must provide accurate information, behave lawfully, avoid prohibited content, and protect login credentials. GUSSEX may review messages for spam prevention.
    Data Usage
    As consideration for free access, users consent to the pseudonymized use of profile, behavior, device, and network data for advertising purposes in accordance with the Privacy Policy (https://gussex.org/privacy). Users may object, which may limit free features.
  16. User Indemnification
    Users must indemnify GUSSEX against damages arising from intentional or negligent violations of these Terms.
  17. Liability
    Gussex is liable only for intent or gross negligence and for breaches of essential contractual obligations. Liability is limited to foreseeable damages. No liability is accepted for third-party user content.
  18. Amendments
    Gussex may amend these Terms at any time. Continued use after notification constitutes acceptance unless the user objects within two weeks.
  19. Dispute Resolution
    The European Commission provides an Online Dispute Resolution (ODR) platform:

GUSSEX does not participate in consumer arbitration proceedings.
  20. Governing Law and Jurisdiction
    These Terms are governed by the laws of Spain. Arbitration for non-consumers shall take place in Barcelona, Spain, in Spanish.
  21. Final Provisions
    If any provision is invalid, the remaining provisions remain effective. In case of discrepancies between language versions, the German version shall prevail.

EU consumers may withdraw from paid subscriptions or credit purchases within fourteen (14) days without stating a reason.
