Introduction
The following general terms and conditions govern the contractual relationship between Gussex (hereinafter, “Gussex”) and the users who use the GUSSEX application, which is owned by Gussex (hereinafter, “users”), and define the conditions that govern the use of the GUSSEX services.
By registering on GUSSEX, in the mobile apps for iOS and Android (hereinafter, “mobile apps”), the user declares that they accept the general terms and conditions set out below. If the user does not agree with the general terms and conditions, they should not register.

- Scope of Use
The general terms and conditions in this document are valid for use of the GUSSEX website and the GUSSEX mobile apps, as well as for all websites of Gussex that redirect to these general terms and conditions.
Gussex must explicitly authorize in writing any arrangement that differs from these terms and, in particular, any user terms that contradict these general terms and conditions. These general terms constitute the terms of use along with any additional conditions agreed between the user and Gussex. - Performance of the Contract, Contract Start, Fees
a. The contract between GUSSEX and the user is concluded by creating a user account when the user registers free of charge on the website or in the corresponding mobile app. b. The user registers free of charge by completing the registration form. The user may register through third-party login features (e.g., Facebook Connect). When using this option, certain data from the user’s corresponding profiles will be incorporated into the GUSSEX database. By registering via such login functions, the user agrees to the terms of the corresponding provider and authorizes GUSSEX to incorporate certain data into its database. c. GUSSEX reserves the right to deny user registration for objective reasons, including: violation of these terms, fraud prevention issues, doubts about identity, suspicion of spam, doubts about age, bad faith, registration from markets where GUSSEX is not available. GUSSEX may make registration conditional on further steps such as identification or anti-spam measures. d. Use of the service is free and financed by advertising. The user may use paid features through individual purchases or by subscribing. e. Each user is entitled to create only one account. Existing user accounts must be deleted before a new account can be registered. It is prohibited to register more than once, and users blocked by GUSSEX are prohibited from registering again. f. Use is permitted only for natural persons who have reached legal adulthood. g. Use is not permitted for sex offenders. “Sex offenders” includes persons registered as a “sex offender” in the United States or who have criminal records for offenses related to the protection of children and youth or equivalent regional offenses. h. WE DO NOT VERIFY CRIMINAL RECORDS, but in case of well-founded suspicion we may review publicly available information to ensure that no breach of our rules is occurring. - GUSSEX Services
a. GUSSEX Community
GUSSEX operates a social community through the GUSSEX app and provides users access to a database through which they can meet to establish romantic relationships or friendships. The database contains profiles with photos and information about other users. Registered users may view these profiles and contact other users.
GUSSEX authorizes its registered users to use the offered services in accordance with applicable law and these terms to upload, store, publish, distribute, transmit, and share content with other users.
b. Live Video Function - In certain countries, GUSSEX offers mobile app users a Live Video function that allows a user (the “streamer”) to broadcast a live video (“broadcast”) that may be viewed by an unlimited number of viewers.
- Viewers may publicly comment on broadcasts and join as guest streamers. Viewers may give virtual gifts to streamers by exchanging in-app credits.
- Broadcasts may be transmitted simultaneously to other apps owned or operated by Gussex. Users will be informed before such broadcasts begin.
c. Security, Scope and Availability - GUSSEX provides a free spam filter for private messages. No guaranteed success rate is provided.
- GUSSEX may modify the operation and scope of the platform at any time.
- Average annual availability is 96.0%, excluding maintenance, updates, force majeure, and third-party issues.
- Paid Features
Users may purchase subscriptions or virtual goods. Prices are displayed prior to purchase. Paid features may be time-limited and account-linked. EU residents may purchase paid features only within the EU. - Subscriptions
Subscriptions renew automatically unless canceled before expiration. Users may cancel subscriptions with 24 hours’ notice prior to renewal. Subscriptions purchased via Apple App Store or iTunes must be canceled through those platforms. - Virtual Goods
Virtual goods are non-transferable, account-linked, and non-refundable. Deleting an account results in permanent loss of virtual goods. - Termination by the User
Users may terminate their account at any time via account settings or by written request. All paid features expire upon termination except independent subscriptions. - Termination by GUSSEX
GUSSEX may terminate accounts with notice or immediately in cases of serious violations, fraud, or illegal activity. Refunds apply only if paid features were unused. - User Obligations
Users must provide accurate information, behave lawfully, avoid abusive or illegal content, and protect their login credentials. GUSSEX may review messages for spam prevention.
Data Usage
As consideration for free access, users allow pseudonymized use of profile, device, and behavior data for advertising purposes in accordance with the Privacy Policy (https://gussex.org/privacy). Users may object, which may limit free features. - User Indemnification
Users must indemnify GUSSEX against damages resulting from violations of these terms. - Liability
GUSSEX is liable only for intent or gross negligence and for essential contractual obligations. Liability is limited to foreseeable damages. No liability is accepted for third-party content. - Amendments
GUSSEX may amend these terms. Continued use after notice constitutes acceptance unless the user objects within two weeks. - Dispute Resolution
The EU Online Dispute Resolution platform is available at www.ec.europa.eu/consumers/odr GUSSEX does not participate in consumer arbitration proceedings. - Governing Law and Jurisdiction
These terms are governed by the laws of Spain. Arbitration for non-consumers shall take place in Barcelona, Spain, in Spanish. - Final Provisions
If any provision is invalid, the remaining provisions remain effective. In case of discrepancies between language versions, the German version shall prevail.

EU consumers may withdraw from paid subscriptions or credit purchases within fourteen (14) days without providing a reason.
